M-AIDA: Commercial licensing status

Current status: commercial licensing is NOT available. Economic rights in M-AIDA are not yet formally settled. Until they are, the authors cannot grant commercial licenses. See §2 below.

M-AIDA is released as free/open-source software under the GNU Affero General Public License v3.0 (AGPL-3.0-only): see LICENSE.

Using M-AIDA under the AGPL-3.0 requires no contact and no fee.

1. What the AGPL requires

The AGPL is a strong copyleft license. In particular, its Section 13 (Remote Network Interaction) means that if you run a modified version of M-AIDA to offer a network service, you must make the complete corresponding source of your modified version available to the users of that service.

For most academic and non-commercial research use, these terms impose no practical burden.

2. Why commercial terms are not currently offered

Dual licensing requires the licensor to hold, or to be authorised by all co-holders to grant, the economic rights in the work.

For M-AIDA that condition is not yet satisfied:

Institutional silence does not constitute a waiver of institutional rights. Accordingly, no party, including the authors, is currently in a position to offer M-AIDA on terms other than the AGPL-3.0.

3. What happens when the position is settled

If and when the co-ownership agreement is executed and it permits commercial licensing, this file will be replaced with actual commercial terms, and the change will be recorded in CHANGELOG.md, in the OSF deviation log, and in IP_REGISTER.md.

Licenses already granted cannot be revoked. Any AGPL-3.0 grant already made remains valid regardless of how ownership is subsequently settled. Future commercial terms, if any, would apply only prospectively and only to parties who choose them instead of the AGPL.

Hiện trạng: CHƯA cấp phép thương mại. Quyền tài sản đối với M-AIDA chưa được xác lập chính thức. Chừng nào chưa xác lập, nhóm tác giả không thể cấp phép thương mại. Xem mục 2.

M-AIDA được phát hành dưới giấy phép GNU Affero General Public License v3.0 (AGPL-3.0-only): xem LICENSE. Sử dụng theo AGPL-3.0 không cần liên hệ và không mất phí.

1. AGPL yêu cầu gì

AGPL là giấy phép copyleft mạnh. Đặc biệt, Điều 13 (Tương tác qua mạng) quy định: nếu bạn chạy một bản M-AIDA đã sửa đổi để cung cấp dịch vụ qua mạng, bạn phải cung cấp toàn bộ mã nguồn tương ứng của bản sửa đổi đó cho người dùng dịch vụ.

Với phần lớn mục đích học thuật và nghiên cứu phi thương mại, các điều khoản này không tạo ra gánh nặng thực tế nào.

2. Vì sao chưa cấp phép thương mại

Cấp phép kép (dual licensing) đòi hỏi bên cấp phép phải nắm quyền tài sản, hoặc được tất cả các đồng chủ sở hữu ủy quyền cấp phép.

Với M-AIDA, điều kiện đó chưa được đáp ứng:

Việc Nhà trường chưa trả lời không đồng nghĩa với việc từ bỏ quyền của Nhà trường. Do đó, hiện không bên nào, kể cả nhóm tác giả, ở vị thế có thể cấp phép M-AIDA theo điều khoản khác ngoài AGPL-3.0.

3. Khi quyền sở hữu được xác lập

Nếu và khi thỏa thuận đồng sở hữu được ký và cho phép cấp phép thương mại, tệp này sẽ được thay bằng điều khoản thương mại thực tế; thay đổi được ghi vào CHANGELOG.md, nhật ký sai lệch trên OSF và IP_REGISTER.md.

Giấy phép đã cấp thì không thu hồi được. Mọi giấy phép AGPL-3.0 đã cấp vẫn có hiệu lực bất kể quyền sở hữu sau này được xác lập ra sao. Điều khoản thương mại trong tương lai, nếu có, chỉ áp dụng về sau và chỉ cho bên nào chọn nó thay cho AGPL.
